Turkey has to pay € 16,000 in compensation to Faruk Temel, member of the People's Democracy Party, by reason of a breach of the right to freedom of expression. German national Mehmet Desde was also compensated by the ECHR related to torture allegations.

Mumcu's Relatives Urge for Punishment of Offical Neglect
18 years after the murder of journalist Uğur Mumcu, his family applied to the prosecution to identify and punish the ones responsible for the murder. They demand to punish "the officials who neglected the investigation and the prosecution of the real perpetrators".

Judge and Prosecutor brought Academic to Jail
Lecturer Bilal Bekar was arrested after an argument with a judge in Rize. A court had decreed not to arrest him, but Bekar was taken to jail upon the prosecution's appeal. The teachers' union criticized the arrest as being "contrary to the law".

Three Special Authority High Criminal Courts in Diyarbakır occupy the top three places regarding the number of files decided throughout the past year in Turkey. These courts try important cases such as the KCK trial or the Hezbollah case. They handed prison sentences of several hundred years to Kurdish journalists.

No Decision on Release of "KCK" Defendants
The 16th hearing of the KCK trial against 151 defendants did not bring any new decisions. The request for a defence in Kurdish was dismissed once more. None of the 104 detained defendants was released. The trial was postponed to 18 January.

Communications lawyer İlkiz criticized the RTÜK draft bill: "The government cannot intervene against radio and television broadcasts. The provision should be lifted. It will cause illegal applications".

Trial against Lawyer Rişvanoğlu Postponed again
Lawyer Rişvanoğlu, tried for his statements made on Roj TV, was represented by 28 lawyers in the hearing on 11 January. The case was adjourned once more to wait for an expert report. The Adana Branch of the Contemporary Lawyers Association harshly criticized the trial.

The Diyarbakır 6th High Criminal Court held the 15th hearing of the KCK trial on 13 January. The court reiterated its decision against the defence of the 151 defendants in Kurdish. The request to release the 104 detained defendants was postponed to today.

RTÜK: "Magnificent Century" Series Clashes with "Moral Values"
RTÜK issued a warning to Show TV on the grounds of the series "Magnificent Century". The series about the life of Sultan Suleyman the Magnificent went on air on 6 January. It is alleged to be "contrary to the national and moral values of the society", RTÜK said.

Lawyer Tanrıkulu Sued for "Influencing Judiciary"
The Siverek High Criminal Court will prosecute former Diyarbakır Bar Association President Tanrıkulu on the grounds of his criticism of the Diyarbakır Military Court. The court had decreed for a lack of jurisdiction for the JİTEM case and the release of a defendant.

The European Court of Human Rights convicted Turkey of a violation of the "right to respect for private life" upon an application lodged by 10 prisoners. They had applied because letters in Kurdish written to their families had not been dispatched by the prison administrations.

In a meeting of the Turkish small National Assembly, Kurdish politician Alınak called on the government to hold a referendum on bilingualism (Turkish/Kurdish). Members of the CHP and MHP opposition parties did not attend the meeting.

Businessman Akyüz from Antalya was sued and convicted because of a comment on a television news report he watched at a barber shop. The news was about the closure case of the ruling AKP. Akyüz will be on probation for five years since the sentence was postponed.

Turkish lawyers discuss the judiciary's narrow interpretation of the recent amendment of article 102 of the Criminal Procedure Law. According to Istanbul Bar Association President Kocasakal, defendants should be released after a period of arrest of four years.

Supreme Court Quashed Verdict for Acquittal of Kurdish Singer
The Court of Appeals quashed the verdict for Kurdish singer Tunç's acquittal of charges of "propaganda for an illegal organization". Tunç was initially tried for referring to the death of 17 MKP members in the course of a military operation in 2004 during a performance.

The case filed by former General Head of Prisons and Detention Stations Ertosun against lawyer Tanay and bianet website co-ordinator Kürkçü was postponed to January 2011. Tanay and Kürkçü are facing a heavy compensation claim.

Police officer Tuncay Aktaş is on trial because of beating journalist Ozan Özhan. He is charged with "actual bodily harm". The trial is being continued on 15 December at the Beyoğlu 2nd Magistrate Criminal Court.

RTÜK issued a reprimand to NTV for restaurant owner Güler's statement in a food program. He said, "The wines made mainly from the Nebiole grape variety and from our Boğazkarası grapes are of good quality in my opinion". RTÜK member Alp opposed the vote.

Taraf newspaper writer Neşe Düzel is litigated over an interview with M.Ş. Gençdal, spokesman of a group of the Quandil group that entered Turkey last year upon the call of imprisoned PKK leader Öcalan. Düzel is facing prison terms.

The Trabzon High Criminal Court is waiting for defendant Öz's lawyer, the Magistrate Court awaits the High Court's decision on merging the files.
